Perspectives From the Practice
Michael Kasem
Brand Director — Singapore
We engaged Thapthim to manage our Thailand trademark portfolio after years of handling it ourselves with mixed results. The initial portfolio review was thorough — several marks we had allowed to lapse were identified, and a clear picture of what we actually held was established within the first few weeks. The renewal tracking since then has been straightforward and reliable.

Prapaporn Nithipat
Creative Director — Bangkok
The licensing agreement for our agency's content platform was drafted in a way we could actually follow. Previous legal documents we had worked with were written in language that required its own translation. The Thapthim agreement explained the royalty structure, audit provisions, and termination clearly. When questions came up during negotiation with the licensee, the responses were prompt and substantive.

Ratchanee Ongkham
Operations Manager — Chiang Mai
When we found what appeared to be knock-offs of our product mark at a market, we did not know where to begin. The initial inquiry from Thapthim provided a clear written summary of the available pathways and what each would realistically involve in cost and timeline. It was not what we had hoped to hear in every respect — civil litigation looked less promising than we had assumed — but having an honest picture before committing to an enforcement budget was genuinely useful.

Jonas Thierfelder
IP Counsel — Munich / Bangkok
We needed local Thai counsel to coordinate the Thailand segment of a multi-jurisdiction Madrid filing. Thapthim handled the basic mark assessment, national phase coordination, and the initial DIP response with clarity and within the timeline we needed. Communication in English was consistent throughout, which matters when you are coordinating across multiple offices and time zones.

Siriporn Chalermsak
Founder — Software Studio, Bangkok
The copyright assignment documentation for our software product transfer was handled carefully. We had a deadline linked to a closing condition, and the drafts were delivered in time for review, revised quickly after comments, and signed within the window. The explanation of what voluntary recordation would and would not provide under Thai law was appreciated — it changed our decision on whether to record.

Ananya Lertchai
Legal Manager — Bangkok
We have used Thapthim for opposition proceedings on two occasions. The analysis in each case was well-structured and the evidence assembled for submission was properly organised. The timelines for the proceedings are set by the DIP and outside the firm's control, which meant some waiting — but the communication during that period was clear and regular, so we were never left uncertain about where things stood.

Selected Matter Summaries
The following summaries are presented in general terms. Identifying details have been changed with client approval.
Portfolio Management — Retail Brand, Bangkok
Challenge
A Thai retail brand with fourteen registered marks had no systematic renewal tracking in place. Three marks had lapsed without notice. Two marks were registered in classes that no longer matched the business's current products.
How It Was Addressed
Full portfolio audit conducted over six weeks. Lapsed marks assessed for restoration feasibility. Two marks identified for class amendment. Docketing system established with advance renewal alerts. Three new applications filed in updated classes.
Outcome
Portfolio reduced from fourteen to eleven active marks, with cleaner class coverage. Two lapsed marks restored within the statutory window. Ongoing docketing and watch service now in place. No further lapses in eighteen months since.
"The audit showed us what we actually had, rather than what we thought we had. That was worth considerably more than the filing fees."
Copyright Licensing — Content Studio, Thailand
Challenge
A digital content studio was licensing its video archive to broadcasters under informal agreements. Two licensees had exceeded the agreed territorial scope, and the studio had no audit right to verify usage.
How It Was Addressed
Formal licensing agreements drafted for all active licensees, incorporating territorial restrictions, audit rights, reporting obligations, and termination provisions. Existing licensees were transitioned to the new agreements over a three-month period.
Outcome
All active licensing relationships formalised. Audit exercise conducted under new agreements identified two instances of out-of-territory distribution, leading to renegotiation of scope and adjusted fees. Studio now has a standard licensing template for new licensees.
"We had been working on handshakes. We did not realise how exposed that left us until we saw what proper agreements actually covered."
Knock-Off Inquiry — Consumer Goods Brand, International
Challenge
An international consumer goods brand identified products bearing a mark substantially similar to its registered Thai mark at several Bangkok markets. The company wanted to understand its options before committing to an enforcement budget.
How It Was Addressed
Initial inquiry conducted. Written analysis provided on the marks, assessment of customs recordation as a longer-term deterrent, and an honest view of what police involvement would and would not achieve in market settings. Civil litigation assessed as disproportionate at the identified scale.
Outcome
Customs recordation filing completed. Client opted against civil proceedings based on the cost-benefit reading provided. Police referral made for the largest identified market. Expectations set accurately — the matter remained ongoing at a managed level of engagement rather than full litigation.
"The inquiry saved us from launching an enforcement programme that would not have delivered what we were hoping for. A realistic view early was more valuable than optimism later."
