Terms & Conditions

Last Updated: 14 April 2025  |  Effective Date: 14 April 2025

These Terms and Conditions govern your use of this website and describe the basis on which Thapthim makes its services available. Please read them at your own pace. By using this website, you indicate that you have read and are comfortable with these terms.

1. About This Website

This website is operated by Thapthim, a trademark and copyright practice with its principal office at 374 Phetchaburi Road, Thanon Phaya Thai, Ratchathewi, Bangkok 10400, Thailand. It is intended as a quiet point of introduction to the practice's areas of work and as a way for prospective and existing clients to make contact.

For general enquiries: [email protected]. For data or privacy matters: [email protected].

2. Nature of Information Provided

The content on this website — including descriptions of services, summaries of Thai trademark and copyright law, and any other written material — is provided for general informational purposes only. It does not constitute legal advice, and it should not be read as a substitute for a considered professional assessment of your particular circumstances.

Intellectual property law in Thailand is a living area of practice. Legislation, departmental guidance, and administrative practice change over time. While we take care to keep content reasonably current, we make no representation that any particular passage reflects the law as it stands at the moment you read it. If you are making a decision that depends on a point of Thai law, we recommend obtaining a considered opinion rather than relying on website content alone.

3. No Client Relationship

Using this website, submitting the contact form, or corresponding with us by email does not by itself create an attorney-client or adviser-client relationship between you and Thapthim. A client relationship is formed only when both parties have agreed in writing to an engagement, including the scope of work, the applicable fees, and any relevant terms and conditions for that engagement.

Until a written engagement has been agreed, nothing said or written by Thapthim — on this website, in an email, or in a preliminary conversation — should be taken as legal advice or relied upon as such.

4. Intellectual Property

All written content, design elements, and materials on this website are owned by or licensed to Thapthim and are protected under Thai copyright law. You may read and retain copies of pages from this website for your own reference and non-commercial use. You may not reproduce, adapt, distribute, or publish any portion of this website's content without our prior written consent.

The name Thapthim and any associated service names are identifiers of the practice. Their use in a way that suggests affiliation or endorsement without our written agreement is not permitted.

5. Acceptable Use

In using this website, you agree not to:

  • Use automated tools to systematically copy or extract content from the website
  • Transmit through the contact form any content that is unlawful, misleading, or harmful
  • Attempt to gain unauthorised access to any part of the website or its underlying systems
  • Use the website in any way that could damage its operation or impair other users' access to it
  • Misrepresent your identity or affiliation when making an enquiry

We reserve the right to decline to respond to enquiries that appear to have been submitted with harmful or misleading intent.

6. Third-Party Links

This website may include links to external resources — among them the Department of Intellectual Property (DIP) online services, the WIPO ROMARIN database, and the Madrid Monitor. These links are provided as a courtesy. Thapthim has no editorial control over external websites and makes no representation as to the accuracy, currency, or completeness of their content. Following an external link is at your own discretion.

7. Limitation of Liability

To the extent permitted by applicable Thai law, Thapthim is not liable for any loss or damage — whether direct, indirect, or consequential — arising from your use of this website or reliance on any content it contains. This includes loss arising from inaccuracies in legal summaries, technical interruptions to website availability, or actions taken on the basis of preliminary correspondence that has not been formalised into an engagement.

Nothing in these terms limits liability in circumstances where Thai law does not permit such limitation, including in cases of wilful misconduct or gross negligence.

8. Service Engagement Terms

When a client engagement is agreed, the specific terms of that engagement — including scope, deliverables, timelines, and applicable fees — will be set out in an engagement letter or service agreement. Those documents, together with any applicable professional conduct rules, govern the relationship between Thapthim and the client.

The service descriptions and indicative fees shown on this website are provided for general orientation. They do not constitute an offer capable of acceptance, and the final scope of any engagement will be agreed individually depending on the circumstances of the matter.

9. Fees and Payment

Fees for engagements are agreed in advance and stated in the relevant engagement letter. Indicative fees shown on this website are expressed in Thai Baht (฿) and represent starting points for the relevant service category, subject to adjustment based on the complexity, urgency, and scope of the particular matter.

Official filing fees payable to the Department of Intellectual Property, WIPO, or other registries are in addition to professional fees and will be set out separately. Payment terms will be specified in the engagement documentation.

10. Confidentiality

Information shared with Thapthim in connection with a matter is treated as confidential. We do not discuss client matters with third parties without client consent, except where required by law or where necessary to carry out the engagement (for example, when instructing foreign agents in connection with Madrid Protocol filings).

The treatment of personal data collected through this website is governed by our Privacy Policy.

11. Governing Law

These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any dispute arising in connection with this website or these terms that cannot be resolved by mutual agreement shall be subject to the jurisdiction of the courts of Thailand.

12. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our practice, applicable law, or the nature of this website. When we make material changes, we will revise the "Last Updated" date at the top of this page. Continued use of the website after such changes constitutes acceptance of the updated terms. We recommend reading this page periodically.
